Weathercock Lane Congleton

Reported via desktop in the Fencing/Walls category by Sally Ann Holland at 08:07, Wednesday 18 June 2025

Sent to Cheshire East Council less than a minute later. Council ref: 7726112.

Very old metal fence was hit by a car some years ago on Weathercock Lane, Congleton. It was partially repaired/replaced with a wooden fence, which has since rotted, and was lying on the ground with nails exposed. Deemed dangerous for passers by it was removed from site. All that remains in one section is rope and as there is a brook/millpond beyond it could pose a danger to drivers as there isn't a barrier between the road and the water. it is my understanding that the fence is the responsibility of Cheshire East Highways. Please can this issue be given urgent priority as the highway is exposed in this stretch of road.

  • The asset you have reported is not part of the adopted highway network so the Council is unfortunately not responsible for its maintenance. You can search for the roads we maintain on our website: https://maps.cheshireeast.gov.uk/ ce/ adoptedroadsgazetteer/ Home.aspx

A legal duty to maintain un-adopted roads still exists and this responsibility would fall to the owners of the road, which is typically defined as the owners of any properties fronting that highway or housing developer. It is advised that the residents of the properties meet to discuss the situation and consider how the matter can be collectively resolved.

We are unable to pass on details about landowners, but you can find out information about them through The Land Registry: https://www.gov.uk/ government/ organisations/ land-registry

State changed to: not the council's responsibility
