Sent to Cheshire East Council less than a minute later. Council ref: 5270619.

Significant and deep flooding on the road that is getting deeper each week. This is an ongoing and real problem, it has still not been fixed. This week I had to stop to let traffic pass through on the other side. Also as it is an unlit road and if you are not familiar/aware of the flood issue you will hit it head on. This will impact visibility and safety. On Wedneday morning I hit a patch of black ice before the flood area and I know of its existence. Later on, in the evening the ice was still there and the road ungritted. The flood will cause problems due to the current icy conditions and I would not be surprised if someone has an accident on this road due to the icy conditions and the complete disregard for safety by Cheshire East Council who are fully aware of the flood in this problem area. Please get it sorted before there is an accident and someone loses there life or are injured. You have a duty of care to all road users to maintain the roads in good order under the Highways Act (1980). In particular Sections 41 and 58 which regulate the maintaining and repairing obligations. In addition section 58 of the act, deals with the Highway Authorities obligations to carry out inspections of the highway taking into account various considerations such as frequency of usage, character and location. I note from previous reports that you have inspected the area in question several times, so in this regard you are aware that there are issues here but have still chosen to do nothing. This then makes you liable should an accident occur as a result of the flood/drainage/ice issue. Therefore you would not be able to maintain a defence to a claim that is pursued. I welcome a response but more importantly- get it fixed!
