I have received a response indicating that this is not the responsibility of Highways and it has been passed to Planning. I do not believe that this is appropriate given the state of the pavement and verges and the need for urgent remediation.

The verges and pavement currently are in a dangerous and unpassable condition in places. I personally have already tripped in the verge and have items of clothing ruined

My understanding of the Highways act 1980 is that the the local highway authority has the responsibility to maintain the public highway network, including pavements and verges in a condition that is safe for users. This is clearly not the case here.

Whilst Planning maybe responsible for enforcing specific conditions on developers, it is very unlikely that this particular situation was forseen and subject of any conditions. Even if they were, I doubt any remediation would take palce within an appropriate time scale to avoid further accidents and damage to property
