Ditch blocked breach of Land Drainage Act 1991

Section 25 of Land Drainage Act 1991 The homeowner is refusing to maintain their ditch In accordance with the Land Drainage Act 1991 I therefore request the councils flood Management team and manager write to the two Lands owners to rectify the breach and if needs be act to enforce the maintenance of free flowing water in the ditch in accordance and compliance with the land drainage act 1991.

I therefore request again that under Section 25 of the act to ensure that appropriate maintenance is carried out by riparian landowners on ordinary watercourses. These powers can be exercised by CEBC FLOODS MANAGEMENT TEAM if it is deemed that a lack of maintenance or an alteration to a watercourse pose a flood risk.

I have shown on visits and provided evidence that the two landowners are not complying with the LDA1991 and therefore their failures and that of the council [CEBC] are posing a risk to my property from flooding.

If this is not acted upon I will have no choice but to take the matter to the LGSCO.
