Bottom of conifer hedge at 199 Hurdsfield Road overhangs the public pavement. Although the pavement at this point is sufficiently wide for two pedestrians to pass side by side, they are not able to do so because the usable width is only enough for one person. This means that a pedestrian coming up the pavement from the town has to step into the road to get past a pedestrian walking towards town. This is potentially dangerous because it is on an inside bend and there is insuffient view of traffic coming from the Rainow direction. Although there is no minimum clearance specified in Section 154 of Highways Act 1980, the generally accepted standard is a minimum clearance of 7' 6" over the total width of the pavement. The Cheshire East website states "Hedges and trees adjacent to Public Rights of WayHedges and trees adjacent to Public Rights of Way In most circumstances the responsibilities of the Council do not extend to the maintenance of hedges and trees at the side of Public Rights of Way. Where a hedge overhangs or obstructs a Public Right of Way, the Council has a right to remove as much of the overgrowth as is required to remove the obstruction to users. Additionally, the Council has a power to require the owners of overhanging hedges and trees to cut-back the hedge within a period of 14 days."
